U.S. Citizenship and Immigration Services (USCIS) announced that they have received enough petitions to reach the congressionally mandated for the fiscal year (FY) 2023 H-1B cap, including the master’s cap, (65,000 H-1B visa regular cap and the 20,000 H-1B visa U.S. advanced degree exemption). They also completed sending non-selection notifications to online accounts for registrants. If not selected, status will show: Not Selected: Not selected – not eligible to file an H-1B cap petition based on this registration.

U.S. Citizenship and Immigration Services (USCIS) announced on Tuesday, March 29th, that it has received enough electronic registrations during the initial registration period to reach the fiscal year (FY) 2023 H-1B cap, including the master’s cap. They stated that selections were made randomly from among those applicants that correctly registered. USCIS has notified all prospective petitioners with selected registrations that they are eligible to file an H-1B cap-subject petition for the beneficiary named in selected registration. Registrants’ online accounts will now show one of the following statuses for each registration: Submitted, Selected, Denied or Invalidated-Failed Payment!

U.S. Citizenship and Immigration Services (USCIS) announced on Monday, February 28th, that they reached the H-1B cap of 65,000 for fiscal year (FY) 2022. USCIS has also received more than 20,000 H-1B petitions filed on behalf of persons exempt from the cap under the advanced degree exemption (master’s cap). Remember, USCIS will continue to accept and process H-1B petitions that are otherwise exempt from the cap.

On Wednesday, June 23rd, U.S. Citizenship and Immigration Services (USCIS) announced they will allow resubmit of fiscal year (FY) 2021 H-1B cap-subject petitions that were rejected or administratively closed because of a requested start date after Oct. 1, 2020.

*If your FY 2021 petition was rejected or administratively closed solely because your petition was based on a registration submitted during the initial registration period, but you requested a start date after Oct. 1, 2020, you may re-submit that previously filed petition, with all applicable fees, at the address below. Such petitions must be resubmitted before Oct. 1, 2021. If properly resubmitted, we will consider the petition to have been filed on the original receipt date. *USCIS

USCIS announced on Wednesday, March 30th that they have received enough of the FY 2022 H-1B initial electronic registrations to fulfil the numbers needed to reach the H-1B cap. This initial electronic registration also includes the advanced degree exemption (master’s cap). Registrants’ online accounts will now show one of the following statuses for each registration: Submitted, Selected, Denied, or Invalidated-Failed Payment.

Remember, FY 2022 H-1B Cap Petitions filing starts April 1st!

On Friday, February 5th, USCIS announced that the initial registration period for the fiscal year (FY) 2022 H-1B cap will open Tuesday, March 9, 2021 at noon (Eastern) on March 9 and will stay open until Thursday, March 25, 2021 at noon (Eastern). This is the period that prospective petitioners and representatives will be able to fill out information and complete registration for petitioners.

*Prospective H-1B cap-subject petitioners or their representatives are required to use a myUSCIS online account to register each beneficiary electronically for the selection process and pay the associated $10 H-1B registration fee for each registration submitted on behalf of each beneficiary. *USCIS
