The monthly Visa Bulletin has changed. The bulletin now summarizes the availability of immigrant numbers during the reported month for: “Application Final Action Dates” (consistent with prior Visa Bulletins) and “Dates for Filing Applications,” indicating when immigrant visa applicants should be notified to assemble and submit required documentation to the National Visa Center using Consular Processing (outside of the US) or file on their own with USCIS Form I-485 (within the US).

The U.S. Department of State (DOS) published a revised Visa Bulletin for October 2015 on September 25th. This revised visa bulletin supersedes the bulletin for October 2015 that was originally published on September 9, 2015! The Department of State (DOS) have revised the Visa Bulletin initially issued on September 9, 2015 for OCTOBER 2015.

PLEASE NOTE: The DOS have advised that this bulletin supersedes the bulletin for October 2015 that was originally published on September 9, 2015, and contained Dates for Filing Applications long used by the Department of State for internal processing purposes. Following consultations with the Department of Homeland Security (DHS), the Dates for Filing Applications for some categories in the Family-Sponsored and Employment-Based preferences have been adjusted to better reflect a timeframe justifying immediate action in the application process.

The Dates for Filing Applications sections (sections 4.B. and 5.B.) which have been adjusted have been identified in Bold type.

This month’s Visa Bulletin (October 2015) has changed. The bulletin now summarizes the availability of immigrant numbers during October 2015 for: “Application Final Action Dates” (consistent with prior Visa Bulletins) and “Dates for Filing Applications,” indicating when immigrant visa applicants should be notified to assemble and submit required documentation to the National Visa Center using Consular Processing (outside of the US) or file on their own with USCIS Form I-485 (within the US).

U.S. Citizenship and Immigration Services (USCIS) have announced that they have coordinated with the Department of State (DOS) to revise the procedures for determining visa availability for applicants waiting to file for employment-based or family-sponsored preference adjustment of status (Form I-485) or Consular Processing.

This newly revised process will improve DOS’ ability to accurately predict overall immigrant visa (IV) demand and determine the cut-off dates for visa issuance published monthly in the Visa Bulletin. USCIS and DOS are trying to reduce the month-to-month fluctuations in the Visa Bulletin final action dates.

As projected by the U.S. Department of State, the September 2015 Visa Bulletin shows the EB2 date for nationals from India retrogressed from 10/1/08 to 1/1/06; the EB3 date for nationals from India moved from 6/1/04 to 12/22/04; the EB2 for Chinese Nationals retrogressed from 12/15/13 to 1/1/06; the EB3 for Chinese Nationals moved from 6/1/04 to 12/22/04; and EB3 for WW moved from 7/15/15 to 8/15/15; and the F2A category moved from 12/15/13 to 3/1/14, except Mexico which moved from 11/1/13 to 2/1/14. The F2A category is reserved exclusively for Spouses and unmarried children (under the age of 21) of green card holders (LPRs).
