The Department of Homeland Security (DHS), through the U.S. Citizenship and Immigration Services (USCIS) announced on Tuesday, August 1st new guidance to assist stateless noncitizens in the United States. This guidance will help stateless noncitizens who wish to obtain immigration benefits and/or have submitted other requests to USCIS. A Stateless person is not legally considered a citizen of any country and most likely will be denied legal id, and other services like education, healthcare, marriages and jobs. The Secretary of Homeland Security, Alejandro N. Mayorkas stated, “With this historic step, stateless individuals will be given the opportunity to apply for immigration protections and benefits for which they are eligible.”

The U.S. Citizenship and Immigration Services (USCIS) announced on Thursday, July 27th that they would need to make an additional selection of registrations to meet the FY 2024 H-1B visa allocation. USCIS has now made a random selection of the remaining properly submitted registrations to fill and reach the cap. USCIS stated in the News Alert linked here, “Only petitioners with selected registrations may file H-1B cap-subject petitions for FY 2024, and only for the beneficiary named in the applicable selected registration notice.

The United States Citizenship and Immigration Services (USCIS) will be holding a national conference, “National immigrant integration and citizenship education (NIICE) 2023 conference. (PDF)” on Tuesday, October 17, 2023, between 8:00 am to 5:45 pm (Eastern) and Wednesday, October 18, 2023, between 8:00 am to 4:30 pm (Eastern). USCIS has partnered with the White House Task Force on New Americans (TFNA) and the Interagency Naturalization Working Group (NWG) to present this in-person conference on immigrant integration and citizenship education!

Question #1 – Temporary Work Visa: H-2B

If I come on a seasonal work visa, can I stay in the U.S. until the next work season or do I need to return to the country of which I am a citizen and apply for another visa?

The American Immigration Council (AIC) has released all fifty states and the District of Columbia, for a total of fifty-one updated state-by-state fact sheets highlighting immigration data and facts. These fact sheets highlight the demographic and economic impact of Immigrants in each state.

With national immigration policy being discussed, we thought that it would be a good time to provide some statistics on the Immigrant population in the United States as provided by this AIC research. Once a week we will be posting a blog with information on three states at a time. This week we will highlight; West Virginia, Wisconsin and Wyoming!

The AIC has compiled research which shows that Immigrants are an essential part of each of these states’ economy, labor force and tax base. As our economy continues to grow, Immigrants and their children are a growing economic and political force as consumers, taxpayers and entrepreneurs. As United States economic continues to grow, immigrants and their children will continue to play a key role in shaping the economic and political future of each of these states.

The Department of Justice (DOJ) is reported to be assessing the situation along the Texas-Mexico border over the treatment of migrants by Texas State Troopers! It was reported to DOJ that Texas State Troopers were told to push migrants back into the Rio Grande River and ordered not to give them any water! The DOJ assessment is a possible first step toward a full investigation.

The Administrative Appeals Office (AAO) provides an updated ‘processing times’ in table form, with information on FY2023 third quarterly completions; April 2023 to June 2023. These figures indicate the time that it takes from the date the case is received at AAO coming from the Service Center or District Office to completion.

AAO Processing Times were released with processing dates as of 7/10/23. If you filed an appeal, please review the link below to determine the applicable processing time associated with your particular case.

Note: Starting with the January 2017 Administrative Appeals Office (AAO) Processing Times Report, the AAO has changed how it presents processing time data. The AAO will now provide, by form type, the total number of case completions for the fiscal year quarter and the percentage completed within 180 days, cases completed divided by their projected case goal.
