Question #1 – H-1B Nonimmigrant Visa

What is the minimum time period for which an H1B visa can be issued? Can it be less than 3 years? If yes, what is the minimum number of years for which my employer can sponsor me for a visa?

The Senate confirmed former Tucson Police Chief Chris Magnus as the next U.S. Customs and Border Protection (CBP) commissioner! He was confirmed by a 50-47 vote, with Sen. Susan Collins (R-Maine) voting with Democrats for confirmation! Chief Magnus was nominated in April by President Biden. CBP has over 60,000 employees which include border agents, customs officers and support personnel.

On December 1st, USCIS emailed a bulletin inviting stakeholders to a listening session on Tuesday, December 14th from 2 p.m. to 3:30 p.m. Eastern Time. The listening session is for stakeholders to provide feedback on modernizing and simplifying regulations governing Form I-140, Petition for Alien Workers, with U.S. Citizenship and Immigration Services (USCIS) for employment-based immigrant visa adjudication!

USCIS announced that as of November 29th, all applicants eligible to file for TPS under one of the current designations may file online for Form I-821, Application for Temporary Protected Status, and Form I-765, Application for Employment Authorization. Before this the option to file Form I-821 online was only available to initial TPS applicants from certain countries. 

Here is the list of countries which are currently designated for TPS:

The American Immigration Council (AIC) has released all fifty states and the District of Columbia, for a total of fifty-one updated state-by-state fact sheets highlighting immigration data and facts. These fact sheets highlight the demographic and economic impact of Immigrants in each state.

With national immigration policy being discussed, we thought that it would be a good time to provide some statistics on the Immigrant population in the United States as provided by this AIC research. Once a week we will be posting a blog with information on three states at a time. This week we will highlight; South Dakota, Tennessee and Texas!

The AIC has compiled research which shows that Immigrants are an essential part of each of these states’ economy, labor force and tax base. As our economy continues to grow, Immigrants and their children are a growing economic and political force as consumers, taxpayers and entrepreneurs. As United States economic continues to grow, immigrants and their children will continue to play a key role in shaping the economic and political future of each of these states.
