The Senior Policy Manager for United We Dream, Juliana Macedo Do Nascimento stated that, “The Biden administration made lots of promises during their election campaign and we expect them to follow through on them.” She continued, “We are still very much focused on Build Back Better. It didn’t pass last year but we know Senate Democrats are working with their caucus to make sure it’s passed at the end of the day and the immigrant population is protected.” United We Dream is an organization that is made up of Deferred Action for Childhood Arrivals (DACA) recipients.

Question #1 – Marriage Based Green Card Sponsorship

The Secretary of the Department of Homeland Security, Alejandro Mayorkas stated that, “At a time of record job growth, additional H-2B visas will help to fuel our Nation’s historic economic recovery,”! The Department of Homeland Security (DHS) and the Department of Labor (DOL) announced on Monday, December 20th they were making an additional 20,000 H-2 B temporary nonagricultural worker visas for the first half of fiscal year (FY) 2022 available. They also announced that 6,500 of these additional H-2B visas were being set aside for nationals of Haiti and the Northern Triangle countries of Honduras, Guatemala, and El Salvador. Secretary Mayorkas also stated, “DHS is taking action to protect American businesses and create opportunities that will expand lawful pathways to the United States for workers from the Northern Triangle countries and Haiti. In the coming months, DHS will seek to implement policies that will make the H-2B program even more responsive to the needs of our economy, while protecting the rights of both U.S. and noncitizen workers.”

The Department of State has released its latest Visa Bulletin.

The monthly Visa Bulletin has changed. The bulletin now summarizes the availability of immigrant numbers during the reported month for: “Application Final Action Dates” (consistent with prior Visa Bulletins) and “Dates for Filing Applications,” indicating when immigrant visa applicants should be notified to assemble and submit required documentation to the National Visa Center using Consular Processing (outside of the US) or file on their own with USCIS Form I-485 (within the US).

Because of natural disasters like what has just taken place in Kentucky with the high winds and nighttime tornados, the USCIS would like to remind the public that they offer immigration services that may help people living in these disaster areas. There are many unforeseen circumstances, not just natural disasters they can help with involving immigration! 

*Here are some of the following actions that may be available upon request (case-by-case basis): 

  • Changing a nonimmigrant status or extending a nonimmigrant stay for an individual currently in the United States. Failure to apply for the extension or change before expiration of your authorized period of admission may be excused if the delay was due to extraordinary circumstances beyond your control; 

The United States Citizenship and Immigration Services (USCIS) will be holding a national webinar, “Immigration Options and Resources For Victims of Human Trafficking” on Thursday, January 27, 2022, between 2:00 to 3:30 pm (Eastern). This webinar will provide an overview of the T visa program, resources for trafficking victims and interested stakeholders and many other related subjects. There will be experts providing answers and discussion of pre-submitted questions, so they encourage participants to submit questions early. January has been designated as National Slavery and Human Trafficking Prevention Month!
